What Is A Summary Offence?

They are generally less serious criminal offences, and generally follow slightly different procedures than more severe crimes. You may not be arrested for a summary offence but you will have to attend court on a specific date for a hearing. These offences don't require a jury and typically issue less severe sentences for convictions.

Certain summary offences are also considered hybrid offences. This means, depending on the circumstances, the procedure man include processes and sentencing reserved for more serious offences (known as indictable offences) such as a trial by jury or prison sentences.
